Subject: 19009/Greenway Advisory Board/repeal No. 18146 Date: Fri, 26 Oct 1990 10:52:00 -0500 RESOLUTION NO. 19009 A RESOLUTION TO REPEAL RESOLUTION NO. 18146, ENCAPTIONED AS SET FORTH BELOW, AND TO ESTABLISH THREE GREENWAY ADVISORY BOARDS AND A GREENWAY COORDINATING COUNCIL AS ADVISORY BODIES FOR THE DEVELOPMENT OF A GREENWAY PROGRAM IN THE CITY OF CHATTANOOGA, TENNESSEE. WHEREAS, the City Council of the City of Chattanooga desires to involve individual citizens in the planning, acquisition and development of a greenway system; to place priority on the acquisition and development of greenways; and to develop a long-range greenway program; SECTION 1. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Resolution No. 18146, encaptioned as follows: A RESOLUTION TO ESTABLISH A GREENWAY ADVISORY BOARD AS AN ADVISORY BODY FOR THE DEVELOPMENT OF A GREENWAY PROGRAM. be and the same is hereby repealed; SECTION 2. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE: Greenway Advisory Boards; Establishment, Duties, Consultation and Support. (a) Advisory bodies to be known as the Greenway Advisory Boards (hereinafter sometimes referred to collectively as the "Boards") are hereby established. There shall be three Boards: (i) the Central City Greenway Advisory Board, (ii) the North River Greenway Advisory Board, and (iii) the Brainerd Area Greenway Advisory Board. The Central City Greenway Advisory Board shall perform its duties in the area of the City of Chattanooga south of the Tennessee River and west of Missionary Ridge including the western slope of Missionary Ridge. The North River Greenway Advisory Board shall perform its duties in the area of the City of Chattanooga north of the Tennessee River. The Brainerd Greenway Advisory Board shall perform its duties in the area of the City of Chattanooga south of the Tennessee River and east of Missionary Ridge including the eastern slope of Missionary Ridge. (b) Each Board shall consist of nine (9) members to be appointed by the Mayor subject to confirmation by the City Council. An unlimited number of other persons may be appointed by each Board to serve as auxiliary members. Each Board shall elect annually a Chairperson and a Secretary, and each Board may also elect such other officers and form such committees as it may desire. All Board members shall serve for terms of one (1) year, or until their successors have been appointed and confirmed. Each Board shall establish its own schedule for meetings and shall make its recommendations to the Greenway Coordinating Council. (c) There is also established a Greenway Coordinating Council which shall consist of nine (9) members, three members from each of the Boards. The Greenway Coordinating Council shall be responsible for coordinating the recommendations of the Boards on a city-wide basis. Each Greenway Advisory Board shall name three of its members annually to serve on the Greenway Coordinating Council. The Greenway Coordinating Council shall meet not less than three times per year and shall make its recommendations concerning the establishment of greenways in the City of Chattanooga to the City Council. (d) Each Greenway Advisory Board shall consider potential greenways to be developed, and in developing its recommendations each Greenway Advisory Board shall consider the following items, among others: (1) Areas within its geographical boundaries and adjacent to its boundaries in which greenways may be developed; (2) Criteria to be used in the selection and development of greenways; (3) Means of encouraging the donation of components of greenways; (4) The appropriate organization and role of members and auxiliary members in helping the City to acquire property needed for greenways; and (5) The appropriate level and means of maintaining such greenways. (e) In considering a particular proposed greenway, each Board shall consider the following items, among others: (1) The nature, extent and cost of the development of the greenway; (2) Specific criteria such as surface dimensions and desirable uses to be employed in the development of the greenway; (3) Specific means of encouraging the donation of components of the greenway; (4) Recommendations to the City concerning acquisition of land for the greenway; (5) The appropriate level and means of maintaining the greenway; (6) Assist in developing policies for Greenway administration; (7) Recommend special activities and schedules for the greenway; and (8) Inform the public as to the environmental, recreational and economic benefits associated with greenways. (f) No quorum shall be required for any meeting except for meetings where the Board as a body deliberates toward or adopts recommendations to the City concerning the matters set forth hereinabove in which event a majority of the members appointed shall constitute a quorum. (g) Individual members or auxiliary members of the Boards may volunteer to assist the Administrator of the Department of Parks and Recreation or his designee in the negotiations for and acquisition of components of greenways, provided, no gifts shall be accepted and no purchases shall be made without approval of the City Council. (h) In carrying out its duties, the Boards may seek the support and assistance of the Chattanooga-Hamilton County Regional Planning Commission, the City Attorney, the Land Agent, and where appropriate, other City departments and agencies before making its recommendations to the City Council.
